Your trademark needs expertise. Here’s mine.

Hi, I’m Derrick Morgan Jr., Managing Attorney at Morgan Business Solutions, a Dallas-based law firm focused 100% on trademarks.

I’m a U.S.-licensed attorney (MO Bar #71652) and I’ve helped 3,000+ clients in 80+ countries protect, defend, and monetize their brands.

  • A trademark is what legally protects your brand. Whether you’re selling on Amazon or running a company with offices in five countries, operating without one leaves you exposed:

    • Someone can try to use your name and may even succeed in blocking you from using it first.

    • Platforms like Amazon can suspend your listings if another party files before you.

    • It’s harder to enforce your rights or stop competitors from using confusingly similar names.

    • Expanding, franchising, licensing, or selling your brand becomes a lot riskier.

    • Many investors look for trademark protection early because it’s a sign your brand is protected and scalable.

  • When you try to file your trademark yourself, three things usually go wrong:

    • You pick the wrong class, which can lead to a refusal.

    • You describe your products incorrectly, causing delays and extra fees.

    • You don’t run a proper clearance search, so a similar brand ends up blocking you.

These mistakes can cost people months, often thousands of dollars, and in many cases force them to rethink or rebuild their entire brand identity.

That’s why you’re here: to get it right the first time.

How many classes do you need? (Don’t worry, this part is super easy)

Think of classes like buckets.

Each bucket protects a different part of your business.

Most brands fall into one of three groups.

ONE BUCKET

Works if your brand focuses on a single product or service.

TWO BUCKETS

A common setup for businesses that offer a product and a related service, or operate in two close categories.

THREE BUCKETS

Ideal for brands that cover multiple industries or have several product lines.

There’s no universal rule. Some businesses only need one class. Others need more.

When you check out, simply choose what feels closest to your brand’s structure, and our team will confirm the right number before we file anything.

What you need to start your trademark filing today (nothing crazy)

  • Many brands don’t fit in just one bucket, we usually recommend two classes.

    Here’s the simple breakdown:

    • 1 class:

This works if your brand does one single thing.

If you only plan on selling one product in one class or offering one service, this might be a great fit for you.

But this often leaves brands under-protected.

    • 2 classes:

This provides more robust protection for most brands. If you sell multiple categories of products, 2 classes is probably a better fit.

If you offer a service and sell products, 2 classes.

If you're planning to expand within 1 year, 2 classes.

This is a safer choice for most businesses.

    • 3 or more classes:

This is for brands that cover multiple categories of goods/services.

You can start with less, and we’ll let you know after reviewing your information if a third class will be better.

    Bottom line:

If you're seeking protection and want to protect, monetize and defend your brand, this is a step in the right direction.

  • The form looks long, but don’t stress, it’s mostly basic info you already know by heart.

Here’s what you’ll need on hand:

    • Your brand name or logo

    • Your full name or your company name (who owns the trademark)

    • Your address (home or business — one will be made private)

    • Your email + phone number

    • What your business sells (be specific, not “clothing,” more like “hats, shirts, socks”)

    • Your website, if you have one

    • Two competitors (everyone has them)

    • If you’ve already used the brand, the month/year you first used it

    • If you’re using it now, any photos or links showing the brand on your product or service

    • If your brand includes a real person’s name, we need to know who

    • If the name includes a non-English word, tell us what it means

    That’s it.

Nothing official, nothing complicated, just normal business info.

Once you submit the form and checkout, we review everything, confirm your classes, and make sure your application is filed correctly.

  • You click “Proceed to checkout,” submit your info, and our team reviews everything before filing.
