A declaration to the USPTO that the trademark has now been used in commerce with the designated goods/services.
Statement of Use
This is the final step to register your trademark!
Your application has been initially approved but before registration is issued you have to show proof/evidence that you are using the trademark with the goods/services you applied for.
When you filed your trademark, it was based on “Intent to Use” — meaning you planned to use your brand but hadn’t started yet.
Here’s what you’ll need to do:
Provide a Specimen/Evidence:
This would be a photo or link to your goods/services showing your brand name exactly as it appears on your product, packaging, website, or marketing materials.
For example: a clothing tag or a product label attached to your product, or a screenshot of your functioning online store, etc.
Products that are out of stock, or websites that say ‘Coming Soon’ do not work.
