Statement of Use

The Statement of Use (SOU) is the final step to register your trademark!

This means your application has been approved but before registration is issued you have to show proof you are using the trademark with the goods/services you applied for.

When you filed your trademark, it was based on “Intent to Use” — meaning you planned to use your brand but hadn’t started yet.

Here’s what you’ll need to do:

• Provide a Specimen/Evidence:

  • This would be a photo or link to your goods/services showing your brand name exactly as it appears on your product, packaging, website, or marketing materials.

  • For example: a clothing tag, a product label, a screenshot of your functioning online store, etc.

• Select the number of classes

  • If you’re unsure, you can search the email we sent you or double check by typing in your serial number at https://tsdr.uspto.gov and clicking classes.

• Submit Payment

• Complete Your Form
